Announcement on Phytosanitary Requirements for import of plant-derived Chinese medicinal materials from Nepal to China

According to the requirements of the relevant laws and regulations of the People`s Republic of China and the general administration of Customs of the People`s Republic of China (hereinafter referred to as “GACC”) and the Ministry of Agriculture and Livestock Development of the Government of Nepal (hereinafter referred to as “MoALD”) on Phytosanitary Requirements of plant-derived Chinese medicinal materials exported to China from Nepal, from now on, Nepal`plant-derived Chinese medicine materials that meet the following requirements are allowed to exported to China.

1. Quarantine basis

(1) ”Biosecurity Law of the People's Republic of China”;

(2) “Law of the People's Republic of China on the Entry and Exit Animal and Plant Quarantine” and its implementation regulations;

(3) “Food Safety Law of the People`s Republic of China” and its implementation regulations;

(4)“Supervision and Administration Measures of Chinese Medicinal Materials Quarantine for Entry and Exit”;

(5)Protocol of Phytosanitary Requirements for Export of Plant-derived Chinese Medicinal Materials from Nepal to China between MoALD and GACC.

2. Name of goods allowed to enter to China

The plant-derived Chinese medicine materials (hereinafter referred to as “Chinese medicine materials”) in this announcement refer to 15 medicinal plant products such as Phyllanthi fructus, which shall be products of wild medicinal plants or cultivated medicinal plants in Nepal (Attachment for details).

3. Enterprise registration

All production, processing and storage enterprises (hereinafter referred to as “enterprises”) that wish to export plant-derived medicinal materials to China shall be registered by MoALD and approved by GACC. The registration information shall include name, address and registration number, so that, whenever any product is detected as non-compliant with the requirements herein, it can be traced back to the establishment with certainty. The registration list shall be forwarded by MoALD to GACC for approval prior to the beginning of exports. GACC will publish the list on its website after review and approval in time. Enterprises that are not registered by GACC shall not be allowed to export medicinal materials to China.

4. List of quarantine pests

MoALD should ensure that plant-derived medicinal materials exported to China do not carry quarantine pests concerned by China (Attachment for details).

5. Management before export

(1) Production and processing requirements.

① Under the supervision and guidance of MoALD, the plant-derived medicinal materials enterprises registered for export to China shall take comprehensive measures to control pests and diseases, including pest monitoring, comprehensive prevention and control, and post-harvest treatment, and keep relevant records.

② The monitoring and prevention of pests in enterprises shall be carried out under the guidance of technical personnel knowledgeable in phytosanitary aspects, and the technical personnel should be trained by MoALD authorized institutions.

③ Once the quarantine pests concerned by China are found in the monitoring, enterprises should take corresponding prevention measures in time to ensure that plant-derived medicinal materials exported to China do not carry quarantine pests concerned by China.

④ The plant-derived medicinal exported to China shall be completely cleared of soil , impurities and dried.

(2) Packing requirements.

① Packaging materials shall be clean and unused, and meet plant phytosanitary requirements in China.

② Traceable information such as product name, country, place of origin (province, city or region), name or registration number of enterprises shall be marked on each package in Chinese or English. Each package shall be marked “Exported to the People’s Republic of China” in Chinese or English.

③ If wooden packaging is used, it must meet the requirements of International Standard for Phytosanitary Measures No.15 (ISPM 15).

④ The transport vehicles or containers in which the plant-derived medicinal materials are loaded for export to China shall be inspected for good sanitary conditions before loading. The transport vehicles or containers shall be sealed, and their seals shall be intact when they arrive at the port of entry in China.

(3) Pre-export inspection, quarantine and certificate requirements

① The plant-derived medicinal materials exported to China shall be subjected to inspection and quarantine supervision by MoALD before leaving the country, and that satisfies the requirements of this Announcement shall be allowed export to China.

② If any quarantine pests of concern to China, soil, plant debris are found during the pre-export inspection, the consignment shall not be exported to China. MoALD shall immediately suspend exports from the relevant enterprises, while it investigates the non-compliance to find out the cause and take corrective measures. Detection records shall be kept and submitted to GACC upon request.

③ Upon completing an inspection, MoALD shall issue a Phytosanitary Certificate for the approved batch in accordance with the International Standards for Phytosanitary Measures 12 (ISPM 12), noticed with the name or code of the enterprises and other information. The following text shall be stated in the additional declaration: “This consignment complies with the requirements specified in the Protocol of Phytosanitary Requirements for Export of Plant-derived Medicinal Materials from Nepal to China, and is free from quarantine pests of concern to China.”

6. Entry quarantine and unqualified treatment

When the plant-derived medicinal materials arrive at Chinese port of entry, the Chinese Customs shall conduct the following quarantine:

(1) Verification of certificate and identification

① Check whether the phytosanitary certificate complies with the provisions of Article 5 (3) of this announcement.

② Check whether the identification on the packaging complies with the provisions of Article 5 (2) of this announcement.

(2) Cargo inspection

Quarantine shall be imposed on imported Chinese medicinal materials according to the relevant laws, administration regulations, rules, and combined with the relevant requirements of this announcement, which pass the quarantine inspection shall be allowed entry.

(3) Unqualified treatment

① The consignment of plant-derived medicinal materials from unauthorized enterprises shall not be allowed entry.

② If a valid Phytosanitary Certificate is missing, the consignment shall be returned or destroyed.

③ If any live organism of quarantine pests of concern to China listed in Attachment or other quarantine pests are detected, or if plant debris or soil are detected, the consignment shall be returned, destroyed or treated.

④ If other non-compliances are found, the consignment shall be dealt with in accordance with relevant Chinese laws and regulations.

⑤ If the above non-compliance is found, GACC will notify MoALD in time, and suspend the importation of plant-derived medicinal materials from the relevant enterprises as appropriate. MoALD shall find out the cause of non-compliance and take corrective measures to prevent a similar situation from happening again. GACC will decide whether or not to cancel the suspension based on the outcome of the corrective measures adopted by MoALD.
